Terms & Conditions for Wine Club Membership -
1. AGREEMENT. By enrolling in a Wine Club Membership, Member agrees to adhere to the terms and conditions outlined herein.
2. LEGAL DRINKING AGE. Member affirms that all individuals listed on the account are at least 21 years of age and all wine shipment recipients are at least 21 years of age.
3. TERM. Member acknowledges that Memberships are limited to two individuals. The Membership is effective on the date of signup and will continue until terminated by either party. During the first 12 months of Membership, Member is required to take all club shipment allocations for Member’s selected tier of Membership. Following the initial 12-month period, Member may cancel their Membership at any time by providing written notice to Domaine Serene at wineclub@domaineserene.com. Cancellation requests must be received prior to the processing of the next recurring shipment to avoid charges. Domaine Serene reserves the right to cancel Member’s Membership at any time and for any reason, including but not limited to breach of Membership Code of Conduct, which can be found here.
4. MEMBER INFORMATION. Domaine Serene shall notify Member of upcoming recurring shipments by email prior to processing each shipment. Member agrees to inform Domaine Serene of any changes to the Member’s address, phone number, email, or credit card information prior to the processing of the next recurring shipment.
5. RECURRING SHIPMENTS. Member agrees to receive recurring shipments of wine according to the selected Membership and authorizes Domaine Serene to charge the Member’s credit card on file for the minimum shipment value associated with each recurring shipment. The primary card on file will be used for shipments. The primary address on file will be used for delivery location. Club allocations cannot be split between multiple credit cards. Recurring shipments and any other order by Member can either be shipped or picked up from a Domaine Serene location under the conditions listed below:
5.1. Pickup
5.1.1. Members may designate one of the following locations as their preferred pickup location: the Domaine Serene Clubhouse located at 6555 NE Hilltop Ln, Dayton, OR 97114; the Domaine Serene Wine Lounge - Lake Oswego located at 300 1st St, Lake Oswego, OR 97034; or the Domaine Serene Wine Lounge - Portland located at 1038 SW Alder St, Portland, OR 97205.
5.1.2. To ensure the order will be ready for pickup when the Member arrives, reservations are required for pickup.
5.1.3. Member agrees to pick up their shipment within sixty (60) days of order processing. As a courtesy, Domaine Serene will reach out to notify the Member that the 60-day pickup window is expiring. If an order is not collected within the 60-day pickup window, the order will be shipped to the Member’s shipping address on file, and the shipping fees charged to the Member’s credit card on file. All communication regarding the 60-day pickup window and any subsequent shipments will be through the Member’s email or phone number on file.
5.2. Shipping
5.2.1. Club shipment allocations cannot be split between multiple addresses. Shipped orders must be signed for at delivery by someone who is at least 21 years of age. Domaine Serene recommends shipping to a business address or FedEx or UPS Authorized Ship Center to ensure delivery on the first attempt.
5.2.2. Domaine Serene is unable to ship to P.O. boxes and can only ship to states that legally permit wine shipments. Any order is subject to the taxes and alcohol beverage delivery laws of the state of delivery.
5.2.3. To ensure the quality of Member's wines, Domaine Serene reserves the right, at its sole discretion, to hold an order due to weather conditions. Orders shipped to Alaska or Hawaii will ship via air.
5.2.4. Once an order has shipped, it cannot be refunded, recalled, customized, or reprocessed. If the order is returned to Domaine Serene, and Member does not make a reasonable alternative arrangement to collect the order, Domaine Serene will re-ship the order to the same shipping address on file and charge the shipping fees to the Member’s credit card on file.
6. REWARDS POINTS. Members will earn rewards points when they purchase Domaine Serene wine or merchandise, which can be redeemed for various experiences and merchandise. Rewards points will be null and void in the event of Membership cancellation. Rewards points are not transferable to another Member. If a Member reactivates their Membership within 12 months of cancellation, points may be reinstated at the discretion of Domaine Serene.
7. MODIFICATION. Domaine Serene reserves the right to modify any aspect of the Membership, including but not limited to frequency of recurring shipments, wines offered, minimum shipment value, wine release schedule, membership benefits, rewards points, rewards offered, these Terms and Conditions, and the Member Code of Conduct. Significant modifications will be communicated in advance of change.
8. MEMBER SEPARATION. In the event of a legal separation, divorce, or relationship dissolution between the Primary Member and Secondary Member named on the Membership, Domaine Serene will distribute any accumulated rewards points and any purchased but uncollected wine in accordance with either (a) a valid court order addressing the distribution of assets between the Members, or, if no court order exists, (b) written direction as to the intended distribution of the assets signed by both Members. Until the receipt of such court order or written directive, Domaine Serene shall maintain all rewards points and purchased wine in the membership account under the name of the Primary Member and may continue to release wine to either member in accordance with normal procedures. Domaine Serene shall not be liable for any distributions made prior to the receipt of a valid court order or written directive.
9. PHOTO RELEASE CONSENT. By attending any event, tasting, or activity hosted by Domaine Serene Winery ("the Winery") or visiting any Domaine Serene location, you consent to being photographed, filmed, or otherwise recorded. Such media may be used by the Winery for marketing, promotional, and educational purposes, including but not limited to print materials, social media platforms, website content, and other advertising channels, without compensation or further approval. If you do not wish to be included in any photographs or recordings, please inform a Domaine Serene representative in writing prior to or during the event. The Winery will make reasonable efforts to accommodate such requests.
10. COMMUNICATION CONSENT. By providing your contact information to Domaine Serene Winery, you consent to receive communications in the following format:
10.1. SMS Messaging Consent. By providing your phone number to Domaine Serene Winery, you agree to receive promotional and transactional text messages, including updates about your membership, orders, events, and special offers. Consent to receive SMS messages is not a condition of purchase.
Opting Out:
You may opt out of SMS messaging at any time by:
• Replying “STOP” to any text message you receive from us.
• Contacting our Member Services team directly.
Standard message and data rates may apply as determined by your carrier. Domaine Serene is not responsible for any fees incurred as a result of SMS messaging.
10.2. Email and Phone Outreach Consent. By providing your email address and phone number to Domaine Serene Winery, you agree to receive communications related to your membership, purchases, events, and exclusive offers. Communication may include promotional emails, order updates, event invitations, and occasional phone calls regarding membership benefits or time-sensitive opportunities. Consent to receive such communications is not a condition of membership or purchase.
Opting Out:
You may opt out of receiving promotional emails at any time by clicking the unsubscribe link in the email. To opt out of phone calls, please contact our Member Services team directly. Transactional communications related to your orders or account will continue as necessary.
Privacy and Data Use:
Your contact information will be used solely for the purposes specified above and will not be shared with third parties, except as required by law or to fulfill your requests. For more information on how we handle your personal data, please refer to our Privacy Policy.
11. MEMBERSHIP INHERITANCE POLICY. In the event of a Member's death where no Secondary Member is listed on the account, Domaine Serene will distribute any accumulated rewards points and any purchased but uncollected wine to the personal representative, executor, or administrator of the deceased member’s estate upon presentation of valid documentation establishing their legal authority. Following notice of the Member’s death and until receipt of such documentation, Domaine Serene shall maintain all rewards points and purchased wine in the Membership account and will temporarily suspend future shipments and billing. Domaine Serene shall not be liable for any distributions made to persons reasonably believed to have proper legal authority to act on behalf of the deceased Member’s estate.
11.1. Membership Closure: If no estate representative contacts Domaine Serene within twelve (12) months of Domaine Serene being notified of the Member’s death, Domaine Serene reserves the right to cancel the membership and address any outstanding balances or credits according to applicable Oregon law regarding unclaimed property.
11.2. Transfer of Membership: Alternatively, the legal representative of the Member’s estate may request to take over the Membership. Such a request must be submitted in writing along with appropriate legal documentation.
